Feds Postpone E-Verify Mandate
On January 27, the U.S. Chamber of Commerce announced that an agreement had been reached with the Department of Homeland Security to delay implementation of the modified E-Verify/Basic Pilot Program. The new implementation date is May 21, 2009.
In addition, the Department of Homeland Security has requested that court proceedings challenging E-Verify be halted until the Obama Administration has had time to review the modified rule.
The E-Verify implementation delay occurred after new White House Chief of Staff Rahm Emanuel issued a memo stating that agencies should "consider extending for 60 days the effective date of regulations that have been published in the Federal Register but not yet taken effect." The Office of Management and Budget and counsel for the Department of Homeland Security were asked to apply the Emanuel memo to the modified rule.
Under the modified E-Verify rule, most federal contractors and subcontractors would be required to verify new employees and reverify their current workforces.
