State Business Groups Fire Off Lawsuit over Workplace Gun Law

Following on the heels of similar laws in Oklahoma, Alaska, Kentucky and Mississippi, Florida has become the latest state to pass a law allowing employees and visitors to keep guns in their cars on employers' premises.

Signed by Governor Charlie Crist on April 15, the law is scheduled to take effect July 1. But not if the Florida Retail Federation and the Florida Chamber of Commerce have their way. The two groups have jointly filed a lawsuit against the Florida attorney in hopes of getting the law tossed out. The Florida Restaurant and Lodging Association may also join the lawsuit.

In their complaint, the business groups argue that the law is unconstitutional because it violates employers' property rights. The plaintiffs also contend that the law "will significantly increase the risk of serious physical harm or death to the customers, employees or other invitees who enter the parking lots or places of business of the Plaintiffs and those of their members who own parking lots in the vicinity of such places."

The Florida Retail Federation, with its 11,000 members, and the Florida Chamber of Commerce, which represents 139,000 businesses, plan to file an injunction to ask the court to delay implementation of the law until there is a hearing.
