LEGAL UPDATE
New Personal Identifiers Rule in Kansas

Kansas Supreme Court Rule 123, concerning the use of certain types of personal data usage in pleadings, went into effect July 1. The result is that pleadings filed with Kansas District Courts will no longer include the following personal identifiers:

  • Social Security Numbers. If an individual's Social Security Number is included in a pleading, only the last four digits of that number will be used.
  • Dates of birth. If an individual's date of birth must be included in a pleading, only the year will be used.
  • Financial account numbers. If financial account numbers are relevant, only the last four digits of these numbers will appear.
The involved parties and counsel are responsible for removing personal data identifiers from pleadings, and the court clerk will not review pleadings to determine compliance with this rule.

The rule does not apply to prior cases. All cases filed before July 1, 2005 will still have all available identifier information.
